Summary/Highlights:

The Reserve at Haw Creek is a proposed 2,800+/- acre development currently in the process of obtaining entitlements for the land.

 

The Planning, Zoning and Appeals Board has requested a joint workshop with the City Commission to discuss the proposed Planned Unit Development (PUD) agreement.

 

The PUD agreement and the developer agreement will be the topics for discussion.



Background:

The PUD Agreement is a 65-page document that outlines the specific development (zoning) criteria that will govern the land associated with the proposed Reserve at Haw at Creek development.  Some of the items addressed in a PUD Agreement are lot sizes, setbacks, lot coverage, building height, or any other development subject matter that would be regulated by the City's Land Development Code.

 

The developer agreement is a document that outlines provisions and financial obligations of the developer to build and pay for specific infrastructure improvements required for the development to occur.  Infrastructure includes but is not limited to potable water, sanitary sewer, reclaim, stormwater, transportation, solid waste, emergency services, public safety, etc.  This is the agreement that would involve the City and the developer only.  The developer would approach other agencies such as the Board of Flagler County Commissioners or the Flagler County School Board with a similar type document as the City has no authority to enter into a financial agreement for any other agency.

 

The developer has prepared a presentation and will be presenting information regarding the entitlements and what the development process entails. They will also address key concerns the public has brought up over the course of the proposed development process to date.

 

*The documents provided are DRAFTS. They are subject to change based on continued comments from City staff during technical reviews, from other agency staff during their review of documents and from comments that might arise during a Public Hearing.*



Staff Recommendation:

There is no staff recommendation. This is a workshop between the City Commission and PZA Board to review and discuss the proposed PUD and Developer agreements. No official action (approval or denial of anything) can legally be taken during a workshop.
