This is a request to execute a sewer easement agreement with Abundant Life Ministries-Hope House Inc. for a public sewer line that runs through the development site.
Background:
Upon review of the major site plan for the Phoenix Crossings development, it was noticed that there is an existing active public sewer line that runs from the City's Wastewater Treatment Facility through Parcel ID: 10-12-30-0850-02130-0030 in an east to west fashion. With this sewer line being one of the main pipes that runs to the facility, it was determined that a non-exclusive perpetual easement must be granted to ensure proper maintenance of the sewer line.
The easement agreement would grant a 30-foot-wide non-exclusive perpetual easement over, under, upon, and across the area that the sewer line is located within the parcel for installation, operation, maintenance, repair, and replacement.
Staff Recommendation:
Staff recommends the City Commission approve the sewer easement agreement with Abundant Life Ministries-Hope House Inc. for a 30-foot-wide perpetual, non-exclusive sanitary sewer easement.
